Welcome to QRDb and Overtext. These Terms of Service ("Terms") govern your access to and use of our URL shortening, QR code generation, white-label routing, and SMS event blast services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptable Use Policy

You agree not to misuse our Services. Specifically, you shall not use QRDb or Overtext to:

• Generate short links or QR codes that redirect to illegal, malicious, phishing, malware, or sexually explicit content.
• Send unsolicited spam, deceptive marketing, or messages that violate the CAN-SPAM Act, TCPA, or any regional anti-spam legislation.
• Attempt to bypass our security measures, rate limits, or reverse engineer our platform architecture.

We reserve the right to immediately disable any links, delete accounts, and report to relevant authorities if we detect abusive behavior.

2. SMS and Event Blast Compliance

If you utilize our Smart SMS or Event Blast modules, you explicitly represent and warrant that:

• You have obtained explicit, legally compliant consent (opt-in) from every mobile number recipient on your list.
• Your messages will include clear opt-out (unsubscribe) instructions as required by law.
• You will bear full legal responsibility for the content and delivery of your messages. QRDb acts solely as a technological conduit and routing service.

3. Intellectual Property and White Labeling

When utilizing the Overtext white-label service, you retain ownership of your custom domains and the specific content you link to. We retain all rights, title, and interest in and to the underlying QRDb technology, software, algorithms (including our 6-digit domain structures), and platform analytics interfaces.

4. Disclaimer of Warranties

Our Services are provided "AS IS" and "AS AVAILABLE". While we strive for maximum uptime and ultra-fast redirection, we do not warrant that the Services will be uninterrupted, error-free, or entirely secure. We make no guarantees regarding the delivery success rate of SMS messages due to the inherent reliance on third-party telecom networks.

5. Limitation of Liability

To the maximum extent permitted by law, QRDb, Overtext, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services, or from any unauthorized access to or alteration of your transmissions or data.

6. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Services, including pricing plans (such as the $24.99/month Overtext tier), with or without notice.
